The following Disclaimers provide important information about the limitations of our liability and the nature of our services at Tattoo Image. By choosing to get tattooed or pierced at Tattoo Image, or by using our website and social media, you acknowledge and agree to these disclaimers. They are designed to ensure you have realistic expectations and understand what risks you assume.

 

1. General Liability Disclaimer for Services

 

Tattooing and body piercing are services that you elect to receive at your own risk. While Tattoo Image commits to performing these services with the utmost care, skill, and cleanliness, there are inherent risks involved and outcomes can vary. Tattoo Image is not liable for any injuries, complications, or adverse effects that may occur during or after the procedure, except in cases of proven negligence on our part. By receiving our services, you agree to release Tattoo Image and its artists/piercers from responsibility for such issues, as long as proper procedures were followed.

 

Key points under this disclaimer:

    •    Inherent Risks: You understand that the processes of tattooing and piercing involve breaking the skin, which carries natural risks. These include pain, bleeding, swelling, scarring, infection, and allergic reactions. We have explained these risks in our Terms and in person. By going forward, you accept that such risks exist. If any of these occur, it is not automatically the fault of Tattoo Image. We mitigate risks through hygiene and technique, but we cannot eliminate them 100%. For instance, if despite all precautions you still develop a minor infection, that is a known possibility and not due to wrongdoing by the artist.

    •    Aftercare Responsibility: A significant portion of the outcome is in your hands after you leave the studio. As noted, if you do not follow aftercare instructions or expose the fresh tattoo/piercing to unclean conditions, the likelihood of complications increases and Tattoo Image is not responsible for any resulting harm. We cannot be at your home to ensure you clean your tattoo or avoid touching your new piercing with dirty hands. Thus, if a problem arises that can be traced to poor aftercare (as determined by, say, a medical evaluation or clear evidence of neglect), you agree that you will not hold Tattoo Image liable.

    •    No Warranties on Artistic Outcome: We provide a service of artistic expression – we do not provide a warranty or guarantee on the permanence or perfection of the art. For example, we cannot guarantee a tattoo won’t fade or that lines will remain razor-sharp years later. We cannot guarantee a piercing will never have issues or will remain viable if you don’t keep jewelry in. These things largely depend on individual skin/body differences and care over time. We do promise to deliver the service as agreed (the design, placement, jewelry choice) to the best of our ability at the time of service. But once done, the result is subject to the whims of healing and time.

    •    Limitation of Liability: In the unlikely event that you have a legal claim against us, our liability is limited to the cost of the service provided (the amount you paid). Tattoo Image will not be liable for any indirect or consequential damages (for example, if you claim the tattoo caused you to miss work for a week, we are not paying for lost wages; or if you say it caused emotional distress beyond the physical aspects, we are not compensating for that). Some states don’t allow exclusion of certain damages; we’re not trying to skirt any mandatory liability, but we are saying we’re not taking on extra liabilities that we are not required to by law. In short, if something is found to be our fault (say, a clear case of using non-sterile equipment which caused an infection), we would be responsible for the direct damages (like medical costs to treat that infection). But if it’s not our fault or if it’s something beyond our control, we’re not responsible. And even if it were our fault, we wouldn’t be paying for extreme claims like “pain and suffering” beyond what a court might deem reasonable. This limitation is standard and by agreeing, you acknowledge it.

    •    Release and Acknowledgment: You will sign a waiver/release at the time of your service that basically echoes these points: that you understand the procedure, you’ve disclosed relevant info, you release us from liability for the known risks, etc. That release works in tandem with this disclaimer. If you refuse to sign, we won’t proceed, and any deposit would be forfeited (because you chose not to go forward under the agreed terms).

 

In summary, Tattoo Image provides a service with certain risks – by proceeding, you accept those risks and agree not to hold us legally responsible for outcomes that are inherent to or a result of those risks. We operate with a high standard of care, and if we genuinely mess up, we will address it. But we can’t insure or guarantee your body’s reaction or your personal aftercare diligence.

 

2. No Medical Advice or Medical Treatment

 

Tattoo Image is not a medical facility, and our services are not medical procedures. We do not offer any medical advice. Any suggestions or information provided by our artists or piercers are based on personal experience and industry practice, not on medical training. For any medical concerns, you should consult a physician.

 

Important clarifications:

    •    Procedures Are Not Medical: Getting a tattoo or a piercing is a personal choice for body art, akin to a cosmetic service. It is not intended to diagnose, treat, cure, or prevent any medical condition. For example, some people get tattoos over scar tissue – that’s fine, but it’s not a medical treatment for the scar; it’s an aesthetic choice. We might tattoo cosmetic designs (like areola tattoos for breast cancer survivors) – while therapeutic in outcome, they are still not medical procedures; they are artistic recreations.

    •    Advice is Informational Only: When we give you aftercare instructions, or when an artist says “in my experience, doing X helps healing,” this is not medical advice. It should not substitute for advice from a licensed healthcare professional. We provide guidelines that work for most people, but we are not doctors. If you have an unusual reaction or something that seems medically concerning, we will always advise you to see a healthcare provider. We won’t try to play doctor by telling you to take certain medications or making a diagnosis. For example, if you think your tattoo might be infected beyond normal irritation, we might say “It could be infected; you should see a doctor.” We will not attempt to prescribe antibiotics or say “that’s definitely an infection” because that would be practicing medicine without a license.

    •    No Medical Endorsements: We don’t claim any health benefits of our services beyond maybe improved self-esteem or aesthetic satisfaction. There are some emerging studies on things like tattooing helping with certain skin conditions or whatnot, but we make no such claims. We also don’t give advice on things like pain management beyond basic over-the-counter suggestions (like “some people take Tylenol before a tattoo” – but we’re not prescribing it). Always follow your own doctor’s advice if they have given you instructions (e.g., if you’re on blood thinners and the doc says skip your dose that day for the tattoo, that’s between you and them – we can’t tell you to do that or not, as that’s medical).

    •    Information on Site: Any health-related information on our website or social media (like a blog post about “How to tell if your piercing is infected” or something) is for general knowledge. We compile it from standard sources and experience, but again, it’s not definitive medical advice. We might even link to or quote medical professionals (like Mayo Clinic guidelines for tattoo aftercare) – but you should always consult your own healthcare provider for personal medical decisions.

    •    Not a Substitute: You acknowledge that consulting Tattoo Image or reading our advice is not a substitute for seeing a doctor. For instance, if you have a condition like keloiding (forming heavy scars) and you ask us if it’s okay to tattoo, we might give anecdotal input (“we’ve tattooed people with keloid tendency; sometimes the tattoo itself doesn’t keloid but it’s variable”). However, that’s not a formal medical clearance. You should still get a professional medical opinion if you’re concerned. We can refuse service if we think it’s unsafe, but our threshold is from a lay perspective; we might okay something that a doctor would caution against, or vice versa. So use medical judgment and professional medical consultation as needed.

    •    Emergencies: In the unlikely event of a medical emergency during a procedure (like a severe allergic reaction, or you lose consciousness and it’s not a simple fainting but something more serious), we will call 911. We have basic first aid training, but we are not equipped to handle medical emergencies beyond initial first aid. You (or your emergency contact) would be responsible for any medical bills resulting from such an event – we don’t cover that, as it’s not something included in the cost of the tattoo/piercing (and unless due to our extreme negligence, which is very unlikely, it falls under assumed risk).

    •    No Medical Records: We don’t maintain medical records on you beyond the consent form information. Any health info you share is used only for assessing if we can proceed. We don’t provide those records to any medical entity or insurance, nor do we have any HIPAA obligations as we’re not a healthcare provider. That said, we treat your info respectfully. Just realize we don’t have things like medical charting or follow-up in a medical sense.

 

By proceeding with Tattoo Image, you agree that you will not construe any information or communications from us as professional medical advice. You will seek a doctor or medical professional for any medical needs or questions. Tattoo Image disclaims any liability for health decisions you make based on information from us – for example, if you decide not to see a doctor for a rash because a non-medical person at the shop thought it was fine and it turns out serious, that’s on you to have gotten a proper medical opinion. We provide our best guidance, but it’s not a doctor’s advice.

 

3. Results and No Guarantee Disclaimer

 

Individual results will vary. Tattoo Image does not guarantee that your tattoo or piercing will turn out exactly as you envisioned, nor that it will heal without flaw, nor that you will experience the same outcome as another client. We provide examples of our work and will give you an honest expectation, but ultimately each body is unique and results are not assured.

 

To elaborate:

    •    Tattoos: Ink can heal differently in each person’s skin. Even with the same artist and technique, one person’s tattoo may heal crisp and dark, while another’s might heal a tad lighter or with minor patchiness that needs a touch-up. We cannot guarantee uniform ink retention. Lighter colors (like white or yellow) often fade quicker or may be less visible after healing – that’s normal, not a failure. Even placement on the body affects it; for example, finger and foot tattoos notoriously fade or blur more – we will warn you, but if you insist on those, you accept that result. Additionally, we cannot guarantee longevity – all tattoos will fade over time, especially with sun exposure. How fast that happens is out of our control (your skin type, lifestyle, etc.). We also cannot guarantee that you will perceive the tattoo exactly as you imagined – there is always a translation from concept to skin. We do our best to meet your expectations, but art is art, not a printable decal.

    •    Piercings: Everybody’s anatomy is different. We might do everything right, but your body could still decide it doesn’t like a piercing (could migrate or reject, especially surface piercings). We cannot guarantee a piercing won’t get irritated or that it will last forever. Some people’s bodies are just tougher on piercings than others. If we advise that a certain piercing may not suit your anatomy (for example, if you don’t have the anatomy for a navel piercing or an industrial, etc.), and you choose to proceed anyway, you especially assume the risk that it may not “take” or heal well. Even in ideal circumstances, there’s a chance a piercing might develop a bump (like a keloid or hypertrophic scar) or an infection – those are known risks and not something we guarantee against. We provide advice to minimize those issues, but no promises.

    •    No Guaranteed “Look”: We often draw a stencil for tattoos and you approve it. However, slight variations can happen during the tattooing process. The exact thickness of a line or vibrancy of a color might not be 100% as the stencil or reference. We match as closely as humanly possible, but clients should allow for minor artistic variance. For freehand work (drawn directly on skin), what’s drawn is an estimate; the final tattoo might have small differences once inked. Piercings are marked and you approve the placement; we aim for that mark, but a millimeter off can happen due to skin elasticity or jewelry insertion – we get it as exact as possible, but bodies aren’t CAD drawings. So, you can’t hold us to an impossible perfection standard – reasonable care is the standard.

    •    Subjective Satisfaction: Art appreciation is subjective. We can’t guarantee that your mom will love your tattoo, or even that you won’t have personal second thoughts. We discuss thoroughly to ensure you’re happy before we start, but after it’s done, if you just “don’t like it” that is not something that makes us liable or obliged to remove/refund. We encourage full communication up front so what ends up on you is what you wanted. If later you change your mind about the content (common scenario: someone breaks up with a partner whose name they got tattooed – we didn’t make that choice, you did, and we can cover it later as a new paid service, but we can’t be responsible for life changes). We do not guarantee that you will continue to be happy with your decision – that’s beyond our scope. We guarantee we’ll do the work as agreed; your feelings about it over time are your own.

    •    Existing Conditions: If you come to us with a pre-existing tattoo to fix or cover, we will do our best but cannot guarantee complete coverage or perfection. Old tattoos, scar tissue – these are variables. We usually explain what to expect (e.g., “the old tattoo might still faintly show through lighter areas”). It’s more of a “we’ll try to improve it significantly” not “we’ll 100% erase all trace”. You have to have realistic expectations. We disclaim guarantee in those scenarios especially.

    •    Examples & Testimonials: Any photos of healed work we show, or testimonials from others (“it healed perfect!”), are individual cases. Your results may vary. You shouldn’t assume because you saw one person’s outcome that yours will be identical. Your skin tone might make colors appear differently, your body might swell more/less, etc. We sometimes show worst-case and best-case examples to educate, but we cannot promise you’ll be on the best-case end of the spectrum. We also won’t claim you will be worst-case; probably somewhere in the middle – but no guarantees.

 

In essence, Tattoo Image provides no guarantee or warranty on the results of tattoos and piercings regarding aesthetic outcome, longevity, or your personal satisfaction. We’ll give you our professional assessment and do quality work, but the rest is up to fate and individual factors. No refunds will be given for outcomes that are within the normal range of what can be expected (including minor imperfections, fading, or personal change of heart). We stand by our work and will do touch-ups when appropriate (per our policy), but that’s the extent of our commitment to result. Beyond that, it’s an art and a service, not a product with a return policy.

 

4. External Links and Third-Party Recommendations Disclaimer

 

Our website and social media might include references or links to third-party websites or products. Likewise, our artists or staff might personally recommend a product (like a specific aftercare soap or moisturizer) or another business (like “go to that shop for laser removal” or “buy jewelry from this brand”). These are provided for convenience or based on our positive experiences, but Tattoo Image is not responsible for the content, quality, or services of any third-party .

    •    Website Links: If on tattooimagehd.com you click a link that takes you to an external site (for example, a link to our artists’ individual Instagram pages, or a supplier, or an article about tattoo care), you have left our website. That other site is governed by its own terms and privacy policy. We do not control what is on those sites. If they have outdated info, broken links, or any issues, that’s on them, not us. We typically link to reputable sources only, but websites can change. We disclaim any liability for any harm or confusion that arises from your use of a third-party site via a link from our site. That includes if you purchase something from them or if their site has a virus or something – we obviously wouldn’t knowingly link to a bad site, but we can’t guarantee their security or honesty.

    •    Recommendations: Sometimes during aftercare instructions, we might say “Use Brand X soap, it’s what we recommend.” We are not affiliated with Brand X, nor do we get kickbacks (unless we explicitly say it’s a sponsored recommendation, which is unlikely in our context). It’s just a recommendation. We are not responsible if you have a bad experience with that product – e.g., if you turn out allergic to it or it doesn’t work as you expected. Use your own judgment and read the product’s label. Same goes for if we recommend a certain ointment, or a type of jewelry from a certain company. We base recommendations on general good results, but cannot guarantee they’ll be perfect for you. Follow manufacturer instructions for any product. If in doubt, ask a pharmacist or doctor (tying back to no medical advice – we might say “use a fragrance-free lotion like Lubriderm,” but if you react to Lubriderm, that’s something only you/your doctor would know or figure out).

    •    Third-Party Services: If we refer you to another specialist (say, a laser tattoo removal clinic, or another piercer for a very specialized piercing we don’t do), understand that we hold no responsibility for services provided by that third party, even though we suggested them.     •    Public Nature of Social Media: If you engage with us on social media (commenting on our posts, tagging us, sending us DMs with pictures of your healed tattoo, etc.), note that these platforms are public or semi-public. While we will handle your content as outlined (credit you, not share private DMs without asking, etc.), anything you post publicly is visible to others beyond our control. Tattoo Image is not responsible for how third parties (other users) might use or interact with content that you or we share on social media. For example, if you post your new tattoo in a Facebook group and mention Tattoo Image, and someone in that group downloads the photo and uses it elsewhere, that’s beyond our ability to prevent. We disclaim liability for the actions of other social media users.

    •    Virality and Sharing: By allowing us to share photos of your tattoo/piercing, you understand it could be reshared by others. We watermark images to keep our credit, but they might still circulate. If your tattoo ends up on a “Cool Tattoos” Pinterest board or something, we didn’t put it there (unless it’s our own board). Things on the internet take on a life of their own. We are not liable for any discomfort or issues arising from wider dissemination of an image of your tattoo that we posted with your permission. We also cannot control comments from strangers on the internet; if a photo of a tattoo goes out, some people might leave rude or inappropriate comments (trolls exist). We do our best to moderate our pages, but can’t police the whole internet.

    •    Use of Our Hashtags or Geo-Tags: If you post content and tag Tattoo Image (through location tagging or hashtags), you’re essentially making it easy for others (including us) to find and see your content. While we appreciate it, be mindful that doing so associates that content with our business publicly. We will assume if you hashtag us that you’re okay with that association. If you later delete or change it, that’s fine, we have no control on your end. But any interim exposure or sharing can’t be undone by us retroactively.

    •    Not Responsible for User-Generated Content: If someone else posts a photo of their tattoo done at Tattoo Image and says something incorrect like “Tattoo Image guaranteed my tattoo would never fade” – that’s user-generated content, not our official statement. We aren’t liable for what others claim we said or did on their personal pages. The only official communications from us would be on our website or our official social accounts or printed materials. Take other sources with a grain of salt.

    •    Indemnity for Social Actions: Similar to earlier indemnification, if you do something via social media that causes us harm (like posting a defamatory review that’s not true, or infringing someone’s copyright and tagging us into a legal issue), you may be held responsible. We don’t foresee this normally, but it’s worth stating that engaging with us doesn’t shield anyone from their own online conduct liabilities.

    •    Promotional Use: If we run a contest or promotion on social media (like “post your Tattoo Image tattoo and tag us to win a gift card”), those promotions will have their own rules. By participating, you typically allow us to share your post (because that’s how you enter). We’ll outline rights in those specific cases, but they’ll basically reflect what’s here: we can share your content for the contest, we aren’t liable if the platform glitches or if someone cheats beyond our control, etc.

 

In essence, Tattoo Image encourages positive social media engagement but cannot be responsible for the broader social media ecosystem and actions of third parties. Be aware of what you share and with whom. We’ll do our part to foster a respectful community and protect your content as described, but the nature of social networks means things can travel far and wide beyond our oversight.

 

6. Limitation of Liability and Indemnification

 

This is a crucial part of the disclaimer: it further limits what Tattoo Image might owe you in damages (if any) and explains situations where you might need to cover us.

    •    Limitation of Liability: To repeat and reinforce, Tattoo Image’s liability to you is limited. If, for any reason, a court finds Tattoo Image liable for something (be it breach of contract, negligence, etc.), our responsibility is capped at the amount you paid us for the service or perhaps a statutory minimum. We will not be liable for extraordinary damages like pain and suffering, emotional distress, lost profits, etc. This applies to any claim arising from your use of our website or services. For example, if a typo on our website led you to some confusion and you claim it caused you loss, we’re not liable for that (it would typically be considered an incidental or consequential damage). Or if a tattoo didn’t come out as you hoped and you claim it caused you emotional trauma – we’re not paying damages for that. This limitation is standard in service agreements: you can’t get a windfall from us beyond maybe getting your money back in a worst case. Some states don’t allow full exclusion of implied warranties or incidental damages – we acknowledge that and this clause will be applied to the maximum extent the law allows . We are a small business, and you understand that you can’t come after us for massive sums over service-related disputes.

    •    Indemnification: You agree to indemnify and hold harmless Tattoo Image and its owners, employees, and agents from any claims, losses, or liabilities arising out of (a) your breach of any of our Terms or policies, (b) your violation of any law or rights of a third party in context of our services, or (c) any negligent or wrongful act by you related to your interaction with our business. What does this mean in plain terms? If we get sued or suffer a loss because of something you did, you have to step in and cover us. Example scenarios: You lied about being 18 and we tattoo you, and then your parent sues us – you’d indemnify us because you breached the age policy and caused that situation. Or you give us an image to tattoo that’s copyrighted and the copyright owner sues – you would defend us or cover our costs because you insisted on that image (i.e., you led us into infringement). Or if while in our shop you behave in a way that injures someone or damages property and they make a claim against us, you’d cover those costs because it was your actions. Essentially, you take responsibility for your own actions and any consequences that bounce to us because of those actions. We, in turn, have responsibility for our actions.

    •    No Indirect Liability: Related to limitation, we are not liable for indirect issues. For instance, if our website is down and you claim you missed an opportunity because of it, we aren’t liable for that downtime in any event. Or if a miscommunication leads to you traveling and wasting time, we might apologize but we’re not legally liable for your travel costs or time lost. Keep expectations reasonable.

    •    Force Majeure: Though not explicitly asked, often disclaimers include that we’re not liable for events beyond our control (natural disasters, acts of God, strikes, etc.) that might affect service (like if we had to cancel your appointment because of an earthquake, obviously we’re not liable for any inconvenience or loss from that).
